ORDINANCE NO. 964
AN ORDINANCE
ESTABLISHING
PROHIBITION OF UNMUFFLED COMPRESSION BRAKES
Be it ordained by the City Council of the City of DeQuincy, in legal session convened, Ordinance No. 964 is hereby amended to read as follows:
WHEREAS, the City of DeQuincy desires to update and modernize its Code of Ordinances regarding ARTICLE VI. NOISE Sec 10-94.
THEREFORE, BE IT ORDAINED by the City Council that Article VI Noise Sec 10-94 is hereby amended to read as follows:
WHEREAS, it shall be unlawful for any person to use an unmuffled compression brake in any area designated by ordinance of the City of DeQuincy where the use of an unmuffled compression brake is prohibited and further identified by regulatory signage with wording similar to the following, “UNMUFFLED COMPRESSION BRAKE PROHIBITED”, “NO UNMUFFLED COMPRESSION BRAKE”, “NO ENGINE BRAKE” or “NO JAKE BRAKE’”
THEREFORE, BE IT ORDAINED the violation of this ordinance shall be a misdemeanor and will result in a fine of $100.00 first offense. $250.00 second offense, and $500.00 third offense along with repeat offenders of three (3) or more times.
BE IT ORDAINED, that the use of unmuffled compression brakes in the following area is prohibited:
All street inside the city limits of DeQuincy
BE IT FURTHER ORDAINED, that this ordinance shall become effective immediately upon the signature of the ordinance and all previous ordinances in conflict with this ordinance be and the same are hereby repealed.
Said Ordinance was introduced on the 11th day of March 2024, a notice of Public Hearing having been published on the 3rd day of April 2024, said Public Hearing having been held on the 8h day of April 2024, with the title having been read and Ordinance considered, on motion by, Scott Wylie seconded by Jim Smith to adopt the Ordinance. A record vote was taken, and the following result was had:

Abstain: 0
This Ordinance was declared duly adopted on the 8th day of April 2024.
