AN ORDINANCE AMENDING APPENDIX A OF THE HOME RULE CHARTER OF THE CITY OF DEQUINCY, LOUISIANA, TO REPEAL THE DESCRIPTIONS AND DESIGNATIONS OF EXISTING DEQUINCY CITY COUNCIL, DISTRICTS, ESTABLISH NEW DEQUINCY CITY COUNCIL DISTRICTS, DESCRIBE THE BOUNDARIES OF EACH NEW DISTRICT AND OTHERWISE TO PROVIDE WITH RESPECT THERETO.
SECTION 1
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEQUINCY, LOUISIANA, in regular session convened, that:
In accordance with DeQuincy Home Rule Charter Section 2-02, Appendix A of the Home Rule Charter of the City of DeQuincy, Louisiana, is hereby amended and reenacted, effective as provided herein, to read as follows:
Appendix A
The four DeQuincy City Council districts shall be comprised of the territory within each district boundary as set forth herein:
District 1
The boundary description for District 1 is as follows:
Beginning at the intersection of the east corporate boundary of the City of DeQuincy and Fourth Street (State Highway 12), thence westerly on the centerline of Fourth Street (State Highway 12) to its intersection with Canterberry Street, thence northeasterly on the centerline of Canterberry Street to its intersection with West Leblanc Street, thence westerly on the centerline of West Leblanc Street to its intersection with North Division Street, thence northerly on the centerline of North Division Street to its intersection with the north corporate boundary of the City of DeQuincy, thence easterly along the north corporate boundary of the City of DeQuincy, and thence southerly on the east corporate boundary of the City of DeQuincy to Fourth Street (State Highway 12), the point of beginning.
District 2
The boundary description for District 2 is as follows:
Beginning at the intersection of Fourth Street (State Highway 12) and Canterberry Street, thence northeasterly on the centerline of Canterberry Street to its intersection with West Leblanc Street, thence westerly along the centerline of West Leblanc Street to its intersection with North Division Street, thence northerly along the centerline of North Division Street to its intersection with the north corporate boundary of the City of DeQuincy, thence generally westerly along the north corporate boundary of the City of DeQuincy, thence southerly along the west corporate boundary of the City of DeQuincy to its intersection with Fourth Street (State Highway 12), thence easterly along the centerline of Fourth Street (State Highway 12) to its intersection with Canterberry Street, the point of beginning.
District 3
The boundary description for District 3 is as follows:
Beginning at the intersection of Fourth Street (State Highway 12) and Canterberry Street, thence westerly along the centerline of Fourth Street (State Highway 12) to its intersection with the southeastern boundary of the DeQuincy Industrial Airpark, thence generally northwesterly, then northerly, then westerly, then southerly, all along the boundaries of the DeQuincy Industrial Airpark (also being the corporate boundaries of the City of DeQuincy and marked as U.S. Census Block 2026 of Group 2 of Tract 24 of Calcasieu Parish) until the intersection of the southwestern boundary of the DeQuincy Industrial Airpark with the southern corporate boundary of the City of DeQuincy, thence easterly on the southern corporate boundary of the City of DeQuincy to its intersection with the right of way of the Kansas City Southern Railway (the boundary with District 4), thence northerly on the right of way of the Kansas City Southern Railway to its intersection with Harrison Street, thence westerly along the centerline of Harrison Street to its intersection with Lake Charles Avenue, thence southerly along the centerline of Lake Charles Avenue to its intersection with Velmer Street, thence westerly along the centerline of Velmer Street to its intersection with Division Street, thence northerly along the centerline of Division Street to its intersection with Harrison Street, thence westerly along the centerline of Harrison Street to its intersection with Hall Street, thence northerly along the centerline of Hall Street to its intersection with Center Street, thence easterly along the centerline of Center Street to its intersection with Division Street, thence northerly along the centerline of Division Street to its intersection with Fourth Street (State Highway 12), thence westerly along the centerline of Fourth Street (State Highway 12) to its intersection with Canterberry Street, the point of beginning.
District 4
The boundary description for District 4 is as follows:
Beginning at the intersection of Fourth Street (State Highway 12) and Canterberry Street, thence easterly along the centerline of Fourth Street (State Highway 12) to its intersection with Division Street, thence southerly along the centerline of Division Street to its intersection with Center Street, thence westerly along the centerline of Center Street to its intersection with Hall Street, thence southerly along the centerline of Hall Street to its intersection with Harrison Street, thence easterly along the centerline of Harrison Street to its intersection with Division Street, thence southerly along the centerline of Division Street to its intersection with Velmer Street, thence easterly along the centerline of Velmer Street to its intersection with Lake Charles Avenue, thence northerly along the centerline of Lake Charles Avenue to its intersection with Harrison Street, thence easterly along the centerline of Harrison Street to its intersection with the right of way of the Kansas City Southern Railway, thence southeasterly on the right of way of the Kansas City Southern Railway to its intersection with the south corporate boundary of the City of DeQuincy, thence easterly on the south corporate boundary of the City of DeQuincy to the east corporate boundary of the City of DeQuincy, thence northerly along the east corporate boundary of the City of DeQuincy to its intersection with Fourth Street (State Highway 12), thence westerly along the centerline of Fourth Street (State Highway 12) to its intersection with Canterberry Street, the point of beginning.
Section II
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEQUINCY, LOUISIANA, that a map outlining the 4 single-member council districts for redistricting of the City Council of the City of DeQuincy is hereby attached hereto, made a part hereof, and labeled as “Map 1”.
Section III
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEQUINCY, LOUISIANA, that this ordinance shall be effective at the end of the term of the incumbent Council Members, and used in the regular election of their replacements, in accordance with Louisiana Revised Statute 33:1371, therefore the DeQuincy City Council districts that were adopted by the DeQuincy City Council on April 9, 2012, shall remain in full force and effect for all purposes, except for the election of members of the DeQuincy City Council at the 2022 general election, until January 1, 2023, at 12 o’clock noon.
Section IV
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEQUINCY, LOUISIANA, that the DeQuincy City Council Districts established in this ordinance shall immediately be effective for the limited purpose of qualifying for and election to the DeQuincy City Council at the 2022 regular election (Nov. 8, 2022 primary and Dec. 10, 2022 general) and shall become fully effective for all purposes on January 1, 2023, at 12 o’clock noon.
Section V
The corporate boundary of the City of DeQuincy referenced in this ordinance means the corporate boundary that was legally in effect on the date of adopted of this ordinance, regardless of any subsequent changes in the corporate boundary.
Section VI
Any ordinances, or parts thereof, held to be in conflict with this ordinance are hereby repealed. If any word, clause, phrase, section or other portion of this ordinance is determined to be legally null, void, invalid, illegal, unconstitutional or otherwise legally unenforceable, all remaining words, clauses, phrases, sections and other portions of this ordinance shall remain in full force and effect, the provision of this ordinance hereby being declared to be fully severable.
