ORDINANCE NO. 982
THE CITY Council of the City of DeQuincy, State of Louisiana, met in regular session on the 9th day of December 2024 and adopted the following Ordinance as an amendment to Chapter 1, Sec 1-8 of the Code of Ordinances to be effective immediately.
WHEREAS, the City of DeQuincy desires to update and modernize its Code of Ordinances regarding the regulation of General penalty.
THEREFORE, BE IT ORDAINED by the City Council that Chapter 1-GENERAL PROVISIONS, Sec 1-8 General penalty is hereby amended to read as follows:
Sec. 1-8. – General penalty.
It shall be unlawful for any person to violate or fail to comply with any provision of this Code or commit any act declared to be unlawful or a misdemeanor and where no specific penalty is provided therefor, the violation of any provision of this Code shall be punished by a fine not exceeding five hundred dollars ($500.00) or imprisonment for a term not exceeding thirty (30) days or by both such fine and imprisonment, within the discretion of the court. Each day any violation of any provision of this Code constitutes a separate offense.
BE IT FURTHER ORDAINED by the City Council that should any section, clause, or provision of this ordinance be declared invalid by any court of competent jurisdiction, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part or parts declared to be invalid. All ordinances or parts of ordinances in conflict with any of the provisions of this ordinance are hereby repealed.
All other sections, paragraphs, subsections, subparagraphs, clauses, phrases, and words of Chapter 1, not specifically amended by this ordinance, are to remain the same.
Said Ordinance having been introduced on the 11th day of November, 2024, notice of Public Hearing having been published on the 4th day of December, 2024, said Public Hearing having been held on the 9th day of December, 2024 with the title having been read and Ordinance considered, on motion by Margaret Brown seconded by Jim Smith to adopt the Ordinance. A record vote was taken, and the following result was had:
