ORDINANCE NO. 921
An Ordinance to sell Immovable property located on Pine Street to Louisiana Insulation Services LLC
The City Council of the City of DeQuincy, State of Louisiana, met in regular session on the 10th day of February 2020, and adopted the following Ordinance regarding the sale of immovable property from the City of DeQuincy to Louisiana Insulation Services LLC.
WHEREAS, the City of DeQuincy has been contacted by Matthew Statum, Manager of Louisiana Insulation Services LLC, regarding the purchase of the property located on Pine Street.
WHEREAS, The City Council has determined in accordance with LRS 33:4712 that the subject property is not needed for public purposes and that the price of $50,000.00 offered for the property by Louisiana Insulation Services LLC, is fair and reasonable and should be accepted.
WHEREAS, the City Council has further determined that the proposed use of the property by this business entity will be beneficial to downtown DeQuincy.
WHEREAS, the City has determined that it would be in the best interests of the City to sell the property subject to a right of first refusal in favor of the City to be included in the Act of Cash Sale to Louisiana Insulation Services LLC, which shall read as follows:
Louisiana Insulation Services LLC, declares that for good and sufficient consideration, the receipt of which is acknowledged, it does hereby grant unto the City of DeQuincy, a right of first refusal such that if Louisiana Insulation Services LLC, its successors or assigns, should desire to sell the property described in the Act of Cash Sale to a third party, the City of DeQuincy shall have the privilege of purchasing the property for the same price for which the Louisiana Insulation Services LLC, would be willing to sell to any other person or entity; but if the City of DeQuincy does not exercise this right of first refusal within 75 days after notice in writing, from Louisiana Insulation Services LLC, its successors or assigns of its intent to sell the property to a third party, this right shall be and become null and void.
THEREFORE, BE IT ORDAINED by the City Council that Mayor Riley Smith is hereby authorized to execute an Act of Cash Sale from the City of DeQuincy to Louisiana Insulation Services LLC, for the sum and price of $50,000.00, to be paid in cash upon proper execution and delivery of the said Act of Cash Sale. The property to be sold by the City of DeQuincy to Louisiana Insulation Services LLC, is described as follows:
Commencing 75 feet North of the Southeast corner of Block 15 of the Original Townsite to the Town of DeQuincy, a subdivision as per plat recorded in Plat Book 2, page 230, records of Calcasieu Parish, Louisiana, thence West 75 feet to the West line of Lot 3 of said Block 15, thence North along said West line of Lot 3 to the Northwest corner of the same, thence in a Northeasterly direction along the North line of Lots 1, 2 and 3 to the Northeast corner of said Block 15, thence South to the point of beginning and being all of said Lots 1, 2 and 3 of Block 15 of the Original Townsite to the Town of DeQuincy, less and except 75 feet off the South end of said lots, together with all improvements situated thereon.
BE IT FURTHER ORDAINED that Mayor Riley Smith is hereby authorized to execute any and all other papers, documents and acts necessary to complete the sale of the above described property by the City of DeQuincy to Louisiana Insulation Services LLC, with the said papers, documents, and acts containing such terms, conditions and provisions as he in his discretion deems meet and proper.
BE IT FURTHER ORDAINED that this Ordinance shall become effective ten (10) days after its passage.
This Ordinance was declared duly adopted this 10th day of February, 2020.
