CITY OF DEQUINCY

ORDINANCE NO. 1009
The City Council of the City of DeQuincy, State of Louisiana, met in regular session on the 13th day of July 2026, and adopted the following Ordinance:
AN ORDINANCE DECLARING CERTAIN PROPERTY LOCATED ON YOAKUM AVENUE AS SURPLUS PROPERTY AND AUTHORIZING THE SALE OF A SERVITUDE TO THE OWNER OF 101 YOAKUM AVENUE
WHEREAS, the City of DeQuincy is the owner of certain immovable property located on Yoakum Avenue identified as Parcel Nos. 00749001A and 01343049; and
WHEREAS, the City Council has determined that a portion of said property is no longer needed for public purposes and should be declared surplus property; and
WHEREAS, the City Council finds it to be in the best interest of the City of DeQuincy to grant a perpetual servitude over a portion of said property to the owner of 101 Yoakum Avenue upon the terms and conditions set forth herein;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of DeQuincy, Louisiana, that:
SECTION 1
The City-owned property located on Yoakum Avenue, identified as Parcel Nos. 00749001A and 01343049 and more particularly described herein, is hereby declared surplus property for the purpose of granting the servitude authorized by this Ordinance.
SECTION 2
The City of DeQuincy is hereby authorized to grant and convey a perpetual right-of-way, servitude, and easement over the following described property:
Commencing at the Southeast Corner of Lot 1 appearing on the plat of survey of P. Kade Van Norman, Louisiana Registered Surveyor, dated January 16, 2026, a copy of which is attached, thence West 15 feet, thence North 99.2 feet running parallel to the Eastern line of Lot 1, thence West 15 feet to the Northeast Corner of Lot 1, thence South 99.2 feet to the point of beginning.
SECTION 3
The servitude shall be granted pursuant to an Act of Servitude substantially in the following form:
ACT OF SERVITUDE
CITY OF DEQUINCY, LOUISIANA, a Louisiana Municipal Corporation domiciled in Calcasieu Parish, Louisiana, whose present mailing address is P.O. Box 968, DeQuincy, Louisiana 70633, appearing herein through its duly authorized representative, Mayor Riley Smith, pursuant to City of DeQuincy Ordinance No. 1009, a copy of which is attached hereto and made a part hereof, hereinafter referred to as “GRANTOR”;
AND
ALMA B. SOILEAU, born Castaneda (SSN# XXX-XX-2285), wife of and married to Norman E. Soileau, Jr., dealing herein with her separate property, domiciled in Calcasieu Parish, Louisiana, whose mailing address is 1198 Edwards Road, Sulphur, Louisiana 70663, hereinafter referred to as “GRANTEE”;
who, after being duly sworn, did depose and say:
That GRANTOR is the owner of the following described property:
Commencing at the Southeast Corner of Lot 1 appearing on the plat of survey of P. Kade Van Norman, Louisiana Registered Surveyor, dated January 16, 2026, a copy of which is attached, thence West 15 feet, thence North 99.2 feet running parallel to the Eastern line of Lot 1, thence West 15 feet to the Northeast Corner of Lot 1, thence South 99.2 feet to the point of beginning.
In consideration of the sum of SEVEN HUNDRED FIFTY-ONE DOLLARS AND FORTY-FOUR CENTS ($751.44), receipt of which is hereby acknowledged, GRANTOR does hereby grant and convey unto GRANTEE, her heirs, successors, and assigns, a perpetual right-of-way, servitude, and easement across the above-described property.
As additional consideration for the granting of this servitude, GRANTEE covenants and agrees:
1. To maintain the servitude area;
2. To keep the servitude area free of structures, obstructions, or other impediments that could disrupt or interfere with the City’s access to the property;
3. To assume all liability in any way pertaining to the servitude area; and
4. To release, indemnify, defend, and hold harmless the City of DeQuincy, its officers, employees, and agents from any and all claims, losses, costs, expenses, damages, or liabilities arising from or connected with the servitude or the servitude area.
SECTION 4
Mayor Riley Smith is hereby authorized and directed to execute the Act of Servitude and any and all other documents necessary to carry out the intent of this Ordinance.
SECTION 5
This Ordinance shall become effective upon signature by the Mayor.
The above Ordinance was introduced on the 13th day of June 2026. Notice of Public Hearing was published on the 8th day of July 2026. The Public Hearing was held on the 13th day of July 2026. The title having been read and the Ordinance considered, on motion by Margaret Brown, seconded by Eddy Dahlquist, to adopt the Ordinance, a record vote was taken, and the following result was had:

This ordinance was declared adopted on the 13th day of July 2026, and effective upon signature of the Mayor on this the 13th day of July 2026.
