ORDINANCE NO. 1006
The City Council of the City of DeQuincy, State of Louisiana, met in regular session on the 11th day of May 2026, and adopted the following Ordinance: An ordinance granting a franchise to LOUISIANA WATER COMPANY (a Louisiana corporation), its successors and assigns, for a period of five (5) years and a provision for an automatic renewal for an additional five (5) years, for the construction, maintenance and operation of water utilities and/or water transmission and distribution systems in, through and across the City of DeQuincy, Louisiana, and for the use of the streets, alleys and public places within the limits of said municipality, as same may be now or hereafter lawfully exist, and repealing all ordinances in conflict herewith SECTION 1. That Louisiana Water Company, (hereinafter designated as “LAWCO”) a Louisiana corporation domiciled and doing business in the State of Louisiana, its successors and assigns, be and said LAWCO is hereby granted the right, privilege and franchise of producing and/or otherwise acquiring, transmitting, distributing and selling water to said municipality, and the inhabitants thereof, with right, authority and privilege to construct, maintain and operate in, along and upon the present and future streets, alleys, bridges and public ways and places of said municipality, lines with all necessary appurtenances for the purpose of supplying and/or selling water to the said municipality and the inhabitants thereof. SECTION 2. That LAWCO, its successors and assigns, shall maintain its water transmission and distribution systems in good condition, and shall comply with all reasonable safety regulations in the operation thereof, and shall maintain water in sufficient amount and pressure, except as rendered impossible or infeasible due to normal and unforeseen infrastructure repair and maintenance, improvement projects, acts of God, or public safety concerns, and shall give adequate service commensurate with the demands thereof, and shall protect and save harmless the City from all claims and damages due to its negligence or assigns, shall extend said water transmission and distribution systems, from time to time, as may be necessary to the end that the said municipality and the inhabitants thereof shall be given adequate service, commensurate with the demands therefore, provided that LAWCO shall not be obligated to extend said water transmission and distribution systems unless LAWCO determines in good faith that the estimated earnings from any required extensions shall be sufficient to pay the cost of service therefrom, including depreciation and a fair return on the property used and useful in providing such service. SECTION 3. That all changes made necessary in LAWCO’s Distribution system, where LAWCO’s distribution system lines are located within City rights of way, in connection with the improvement of streets, roads, bridges, alleys and other public places, shall be made by LAWCO, its successors or assigns, who shall likewise repair all damage to streets, roads, bridges, alleys and other public places caused by the construction or maintenance of said distribution system. SECTION 4. That LAWCO, its successors and assigns, shall operate and conduct its business in accordance with statutory law, regulations, and ordinances and shall adhere to the regulations, orders and rulemakings propagated by the Public Service Commission, as well as the Company’s rules and regulations and tariffs approved and governed by the Louisiana Public Service Commission. SECTION 5. LAWCO agrees that it will, from and after the effective date hereof, collect and remit on a quarterly basis a franchise tax to DeQuincy which shall equal five percent (5%) of the gross water service revenues realized from metered sales during the preceding quarter to water customers located within the corporate limits of DeQuincy. This franchise tax shall be in lieu of all other excise and/or gross receipts taxes. SECTION 6. The franchise and the rights, authorities and privileges herein granted are not exclusive and are granted for a period of five (5) years from and after the date on which this ordinance becomes effective. At the end of the five (5) year period, the franchise will automatically renew for another five (5) year period unless the Mayor and City Council provide a written notice six 2 (6) months prior to the final date of the first five (5) year period to terminate the automatic renewal. Should any provision of this Ordinance be found to violate the Constitution or be illegal, it shall not affect the other provisions of this Ordinance. SECTION 7. That all ordinances or parts of ordinances contrary to or in conflict with the provisions of this ordinance be and the same are hereby repealed, and this ordinance shall take effect from and after its promulgation and its acceptance in writing by LAWCO for itself, its successors and assigns. By adoption of this ordinance, Mayor Smith is hereby authorized to execute any and all documents necessary to carry out its intent. Said Ordinance having been introduced on the 13th day of April 2026, by notice of Public Hearing having been published on the 6th day of May 2026 said Public Hearing having been held on 11th day of May 2026, title having been read and Ordinance considered, on motion by Scott Wylie seconded by Margaret Brown to adopt the Ordinance. A record vote was taken, and the following result was had: YEAS: 5 NAYS: 0 ABSENT: 0 ABSTAINED:0
This ordinance was declared adopted on the 11th day of May 2026, and effective upon signature of the Mayor on this the 11th day of May 2026.
